Justice Scalia's 1989 essay Originalism: The Lesser Evil, 57 U. Cin. L. Rev. 849, which has not hitherto been available online outside of subscriber services such as LexisNexis and Westlaw, is reproduced here by kind permission of the University of Cincinnati Law Review, and forms a crucial part of any attempt to understand Justice Scalia's jurisprudence. The Rule of Law as a Law of Rules, 56 U. Chi. L. Rev. 1175 (1989), remains one of Justice Scalia's most important and enduring contributions to jurisprudence. We reproduce it by kind permission of the University of Chicago Law review.

We also present a 1985 essay from then-Judge Scalia, Economic Affairs as Human Affairs, 4 Cato Journal 703, reproduced by kind permission of the Cato Institute.
